Terms of Service

1. Overview
These Terms of Service ("Terms") govern your access to and use of PelagoPass ("we," "our," or "us"), a digital business card platform operated by PelagoPass. By creating an account or using any part of the service, you agree to be bound by these Terms. If you do not agree, do not use PelagoPass.
PelagoPass is a subscription-based service that allows users to create, manage, and share digital business cards ("Cards") via unique links and NFC-compatible passes.
2. Eligibility
You must be at least 16 years old to use PelagoPass. By using the service you represent that you meet this requirement and have the legal capacity to enter into these Terms.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@pelagopass.com if you suspect unauthorised access.
We reserve the right to suspend or terminate accounts that violate these Terms, are used for fraudulent activity, or are left inactive for extended periods.
4. Subscription Plans & Billing
PelagoPass offers two plans:
- Free — 1 Card, access to basic templates, no scan analytics.
- Premium — Multiple Cards, all templates, scan analytics, and participation in the PelagoPass charity programme (see §5).
Billing is handled by Stripe, Inc. Subscription fees are charged at the start of each billing cycle. Current pricing is displayed at the point of purchase (Premium is currently £5.99/month). You authorise us to charge your chosen payment method on a recurring basis until you cancel.
Price changes: We may change subscription prices at any time. If we increase the price of your active plan, we will notify you by email and via an in-app notice at least 30 days before the new price takes effect. The increase will apply from your next renewal after that notice period. If you do not wish to continue at the new price, you may cancel before the renewal date at no additional charge.
You may cancel your subscription at any time through your account settings or via the Stripe customer portal. Cancellations take effect at the end of the current billing period — no prorated refunds are issued unless required by applicable law.
5. Charity Contributions
PelagoPass operates a charity programme as part of its Premium subscription offering. The following terms govern how it works and what you can expect as a subscriber.
How the fund is calculated
On the 28th of each calendar month, PelagoPass calculates its total gross Premium subscription revenue received during that month. An amount equal to 10% of that total monthly revenue is set aside for charitable distribution. This is a business-level commitment made by PelagoPass — it is not a per-subscriber deduction, and no individual portion of your subscription fee is held separately on your behalf.
How charities are paid
Payments to charities are made manually by PelagoPass on or shortly after the 28th of each month, using the payment method accepted by each charity (which may include bank transfer, Stripe, or other means). The total distributed is split proportionally between charities based on how many active Premium subscribers selected each one at the time of calculation.
Your charity preference
As a Premium subscriber you may select one charity from our approved list. Your selection influences how the monthly fund is allocated — it does not create a direct financial relationship between you and the charity, and PelagoPass remains the sole donor of record. You may change your charity selection at any time in your account settings; the change takes effect in the following month's calculation.
No tax relief on your subscription
Because the charitable payment is made by PelagoPass as a business expense, and not by you personally, you are not entitled to claim Gift Aid or personal tax relief on any portion of your subscription fee. If you require a tax-deductible charitable donation, please donate directly to the charity of your choice.
No guarantee of minimum amount
The 10% commitment is based on actual revenue received each month. If monthly revenue is zero (e.g. during a trial period or if all subscribers cancel), no payment will be made that month. PelagoPass does not guarantee a minimum contribution to any charity.
Charity availability
The list of approved charities may change. If your selected charity is removed from the programme, you will be notified by email and prompted to select a replacement. If no replacement is selected within 30 days, your allocation will be distributed proportionally among the remaining active charities.
Transparency
A record of monthly totals and payments made is maintained internally and is available to view via the PelagoPass admin dashboard. We aim to publish a summary of total charitable contributions annually.
6. Acceptable Use
You agree not to use PelagoPass to:
- Post content that is unlawful, defamatory, harassing, obscene, or fraudulent.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Distribute spam, phishing links, or malware.
- Attempt to reverse-engineer, scrape, or exploit the platform in an unauthorised manner.
- Violate any applicable local, national, or international law or regulation.
We reserve the right to remove any content that violates these rules and to suspend the responsible account without notice.
7. Intellectual Property
PelagoPass and its original content, features, and functionality are owned by PelagoPass and protected by applicable intellectual property laws. Our name, logo, and trademarks may not be used without our prior written permission.
You retain ownership of any content you upload to your Cards (photos, contact details, links, etc.). By uploading content you grant PelagoPass a non-exclusive, worldwide, royalty-free licence to store, display, and deliver that content solely for the purpose of operating the service.
8. Third-Party Services
PelagoPass integrates with the following third-party services. Their own terms and privacy policies apply:
- Supabase — database, authentication, and file storage. (supabase.com/terms)
- Stripe — payment processing and subscription management. (stripe.com/legal)
- Vercel — hosting and edge delivery. (vercel.com/legal/terms)
We are not responsible for the practices or content of these third-party services.
9. Data & Privacy
We collect and process personal data as described in our Privacy Policy. By using PelagoPass you consent to that collection and processing. Key points:
- Account data (email, name) is stored securely via Supabase.
- Card scan events (timestamp, approximate location if permitted) are recorded for analytics.
- Payment data is handled entirely by Stripe — we do not store full card numbers.
10. Disclaimers & Limitation of Liability
PelagoPass is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by law, PelagoPass shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of (or inability to use) the service, even if we have been advised of the possibility of such damages.
11. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and, for material changes, notify you by email or an in-app banner. Continued use of PelagoPass after changes take effect constitutes acceptance of the new Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
